UAB “Klaipėdos flotilė” Online Ticket Sales and Purchase Rules
Chapter I. General Definitions
1. Seller – UAB “Klaipėdos flotilė”, legal entity code 307647146, address L. Ivinskio g. 102-4, LT-45123 Kaunas, phone +370 642 68393, email [email protected] (hereinafter referred to as the Company or the Seller).
2. Buyer – 1) a legally capable natural person, i.e. a person who has reached the age of majority and whose legal capacity has not been restricted by court order; 2) a person between the ages of fourteen and eighteen who has the consent of parents or guardians to enter into a transaction, except in cases where the person is emancipated; 3) a legal entity; 4) duly authorised representatives of all the above-mentioned persons.
3. Ticket – a single-use ticket purchased by the Buyer, granting the right to use the services provided by the Company, i.e. to travel by passenger boat on the routes Klaipėda – Nida, Klaipėda – Juodkrantė, Juodkrantė – Nida, and return routes. A single-use ticket is intended for one passenger travelling in one direction.
4. Passenger – a natural person who uses the services provided by the Carrier.
5. Carrier – a company registered in accordance with the procedure established by law, having the right to transport passengers and cargo by inland waterway vessel, as well as the Seller specified in Clause 1 of these Rules.
6. Website – www.klaipedanida.lt, an online platform where an electronic ticket can be purchased and where information about routes, departure points, ticket prices, sailing conditions, and other information relevant to passengers can be found.
7. Privacy Policy – a document approved by the Seller, which sets out the main rules for the collection, storage, processing, and protection of personal data. The Buyer confirms that they have read the Privacy Policy by ticking the relevant consent box on the website.
Chapter II. General Provisions
8. These UAB “Klaipėdos flotilė” Online Ticket Sales and Purchase Rules (hereinafter referred to as the Rules) establish the rights, obligations, and responsibilities of the parties when the Buyer purchases a Ticket online.
9. The Buyer confirms that they have read these Rules and the Privacy Policy by ticking the relevant consent boxes on the website: “I have read and agree to the online ticket sales and purchase rules” and “I have read and agree to the Privacy Policy”.
10. Only Buyers who meet the conditions specified in Clause 2 of these Rules have the right to purchase tickets sold by the Seller online. By confirming their agreement with the Rules and the Privacy Policy, the Buyer confirms that they have the right to purchase tickets online.
11. If necessary, or in the circumstances provided for by the laws of the Republic of Lithuania, the Seller has the right to amend, correct, or supplement these Rules. The new version of the Rules enters into force from the date of its publication on the official website www.klaipedanida.lt.
12. The Rules apply to the extent that they do not contradict the laws of the Republic of Lithuania. If any provision of the Rules is recognised as invalid, the remaining provisions of the Rules shall remain valid to the extent that they can be applied without the invalid provision.
13. If the Seller has the right or obligation to provide information or documents to the Buyer by email, the Buyer is responsible for providing a correct, functioning email address that belongs to the Buyer.
Chapter III. Ticket Prices, Payment, and Ticket Change Procedure
14. Ticket prices are indicated in euros, including the VAT rate applicable under the legislation in force at the time, if applicable.
15. Ticket prices are provided according to the Company’s officially approved price list, which is published on the website www.klaipedanida.lt.
16. The Buyer may purchase the following types of tickets online:
- passenger ticket;
- passenger with bicycle ticket;
- child ticket from 3 years old;
- senior or disabled person ticket;
- other tickets sold on the website, if such tickets are offered.
17. Tickets for special sailings, private sailings, or other non-standard services may not be sold online. For such services, the Buyer must contact the Seller by email at [email protected] or by phone at +370 642 68393.
18. The Buyer may pay for tickets purchased online using the payment methods provided on the website, including electronic payment systems, online banking, bank card, or other payment methods indicated on the website.
19. Money paid for purchased tickets is non-refundable, except in cases where this is mandatory under the applicable laws of the Republic of Lithuania or where the Seller decides otherwise.
20. A Ticket may be changed to another date if the Buyer informs the Seller of the desired change no later than 7 calendar days before the scheduled sailing.
21. A €5 administration fee may apply for changing a Ticket.
22. A Ticket can be changed only if it has not yet been used and if it is possible to change it to another selected date or sailing.
Chapter IV. Ticket Purchase and Use Procedure
23. The Buyer may purchase tickets on the website www.klaipedanida.lt.
24. In the relevant information fields provided by the Seller, the Buyer must provide the personal data necessary for the proper fulfilment of the ticket order.
25. After selecting a ticket and forming the shopping cart, the Buyer completes all order steps, including providing passenger data, confirming the Rules and the Privacy Policy, selecting the payment method, and making payment.
26. After payment is made, the Buyer receives the electronic ticket or tickets at the email address provided during the purchase.
27. The Buyer is responsible for ensuring that the email address provided during the purchase is correct and functioning.
28. The Ticket may be used only on the date and at the sailing time indicated on the Ticket. The Ticket is considered invalid on another day or at another sailing time, except in cases where the Ticket has been changed in accordance with the procedure established in these Rules.
29. The Buyer must have the Ticket during the sailing and present it upon request to the Seller, the Carrier, or a crew representative.
30. The electronic Ticket may be presented on a phone, tablet, or other smart device, or printed on paper.
31. Used tickets cannot be changed or refunded.
Chapter V. Sailing Changes and Cancellations
32. The Seller has the right to change the sailing time, route, or cancel a sailing due to weather conditions, technical reasons, safety requirements, force majeure circumstances, or other objective reasons.
33. Passenger safety is a priority; therefore, in unfavourable weather conditions, strong wind, storms, technical disruptions, or other circumstances posing risk, sailings may be cancelled or rescheduled.
34. If a sailing is cancelled on the Seller’s initiative, the Buyer may be offered to change the Ticket to another sailing or another solution proposed by the Seller, taking into account the specific circumstances and applicable laws.
35. The Buyer may be informed about significant sailing changes by email, phone, or on the website www.klaipedanida.lt.
Chapter VI. Buyer’s Obligations
36. By purchasing a Ticket, the Buyer undertakes to:
- provide correct and accurate data;
- arrive at the departure point on time;
- have a valid Ticket;
- follow the instructions of the crew and safety requirements;
- not violate public order or the rights of other passengers;
- ensure that accompanying minors, animals, or transported equipment comply with the conditions established by the Seller.
37. The Buyer understands that if they do not arrive for the sailing or are late for departure, the Ticket is considered unused due to the Buyer’s fault, and the money paid for the Ticket is not refunded.
Chapter VII. Final Provisions
38. These Rules shall be governed by the law of the Republic of Lithuania.
39. All disagreements arising from the implementation of these Rules shall be resolved through negotiation.
40. If no agreement can be reached through negotiation, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
